Can you Copyright a Hair Cut?

Dennis Crouch of Patently-O has a great video out on controlling haircuts:

How can I prevent you from copying my hair cut:
Copyright? No, it is functional and the creative aspects are inseparable.
Trademark? No, you are not using it in commerce and TM has a non-functionality limitation.
Trade Secret? No, you are not making reasonable efforts to protect it. I can see it now.
Patent? No, even if novel it is likely not useful
Contract? yes, I give up. I would rather be in a relationship with you then to copy your hair cut.

The last 10 seconds made me laugh out loud. “If you copy my hair style I will end our relationship.” When all else fails look to contracts (ToS or EULA). Although I am not sure I would want to stay in that contract.
